These terms govern your use of Spirit vCards, a digital business card service operated by The Spiritual Agency. Please read them before you create an account.
Who we are
Spirit vCards is operated by The Spiritual Agency, a company registered in England and Wales under company number 13216970, with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom. In these terms, we, us and our mean The Spiritual Agency, and you means the person or organisation using the service.
The service
Spirit vCards lets you build and share digital business cards, each with its own web address and QR code. Depending on your plan you may also be able to add a gallery, collect enquiries, take appointments, connect a custom domain and see analytics for your cards.
Your plan determines how many cards you may create, how much storage you have and which features are available to you. Current plan details are shown on the pricing page and inside your account.
Your account
- You must provide accurate registration details and keep them up to date.
- You are responsible for keeping your password secure and for everything done through your account.
- Please tell us promptly at vcards@the.spiritual.agency if you believe someone else has gained access to it.
- An account is for one person or organisation. It must not be shared or resold.
Acceptable use
You must not use Spirit vCards to publish anything unlawful, deceptive, defamatory, obscene or infringing, to impersonate another person or business, to distribute malicious software, to send unsolicited marketing, or to attempt to gain unauthorised access to the service or to another user data. If you offer wellbeing, therapeutic or healing services, you must not make claims through your cards that you are not able to substantiate.
Your content
You keep ownership of the text, images and other material you upload. You grant us a licence to host, reproduce and display that material for as long as is needed to run the service for you. You confirm that you hold the rights to everything you upload and that publishing it does not breach anyone else rights.
Where visitors submit their details through an enquiry form on one of your cards, those details are yours. You are the data controller for them, and it is your responsibility to handle them lawfully and to tell those people how you will use them. We act only as your processor.
Our content
The software, templates and designs that make up Spirit vCards remain the property of The Spiritual Agency or its licensors. You may use them to build and publish your own cards. You may not copy, resell or redistribute them separately from the service.
Plans, payment and cancellation
Access to Spirit vCards is usually included with a membership of The Spiritual Agency, and may also be bought on its own. Prices are shown inclusive of VAT where it applies. Cancellations and refunds are covered by our refund and cancellation policy.
Availability and changes
We work to keep Spirit vCards available and reliable, but we cannot promise it will be uninterrupted or free of faults. We may need to suspend it for maintenance, and we will give notice where we reasonably can. We may add, change or withdraw features over time. If a change materially reduces what your plan offers, we will tell you before it takes effect.
Suspension and ending your account
You may close your account at any time from within the service. We may suspend or end your access if you breach these terms, if your payment fails, or if we are required to do so by law. When an account ends, your cards stop resolving at their web addresses. We keep your content for 30 days afterwards so that it can be restored if the closure was a mistake, and then delete it. Please export anything you want to keep before you close your account.
Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for loss of profit, loss of business, loss of goodwill or loss of data, and our total liability to you in any twelve month period is limited to the amount you paid us for Spirit vCards in that period. If you are a consumer, your statutory rights are not affected.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your own jurisdiction.
Changes to these terms
We may update these terms from time to time. We will post the revised version here and change the date at the top. If a change is significant we will give you reasonable notice by email before it applies.
